Welcome to TrustEverest. These Terms of Use ("Terms") govern your access to and use of the TrustEverest website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.


1. Acceptance of Terms

By creating an account, writing a review, claiming a business, or otherwise using TrustEverest, you confirm that:

  • You have read and understood these Terms
  • You are at least 16 years old (or the age of majority in your jurisdiction)
  • You have the legal capacity to enter into this agreement
  • You agree to comply with all applicable laws and regulations

1.2 Additional Terms

Certain features or services may be subject to additional terms. These will be presented to you when you access those features. Such additional terms are incorporated into these Terms by reference.


2. User Accounts

2.1 Account Creation

To access certain features, you must create an account. When creating an account:

  • Provide accurate, current, and complete information
  • Use a valid email address that you own
  • Choose a secure password
  • Keep your account information up to date

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Logging out from shared devices

2.3 One Account Per Person

You may only maintain one personal account. Creating multiple accounts to manipulate reviews, ratings, or other platform features is prohibited and may result in all accounts being terminated.

  • Engage in fraudulent or deceptive practices
  • Create risk or legal exposure for TrustEverest
  • Have been inactive for an extended period

3. User Content

3.1 Your Content

"User Content" includes reviews, ratings, comments, photos, and any other content you submit. By submitting User Content, you:

  • Retain ownership of your content
  • Grant TrustEverest a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify, and distribute your content
  • Confirm that your content does not infringe any third-party rights
  • Accept responsibility for your content

3.2 Content Guidelines

All User Content must:

  • Be based on genuine first-hand experiences
  • Be accurate, honest, and not misleading
  • Comply with applicable laws
  • Respect the rights of others

3.3 Prohibited Content

You must not submit content that:

  • Is fake or fabricated: Reviews not based on actual experiences
  • Is purchased or incentivized: Reviews written for compensation without disclosure
  • Contains hate speech: Attacks based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Is harassing or threatening: Personal attacks, threats, bullying, or intimidation
  • Is defamatory: False statements that damage reputation
  • Violates privacy: Personal information, photos without consent
  • Is obscene or vulgar: Excessive profanity, sexually explicit material
  • Promotes illegal activity: Content encouraging or facilitating illegal acts
  • Is spam: Repetitive, promotional, or irrelevant content
  • Infringes intellectual property: Content violating copyright or trademark
  • Contains malware: Viruses, malicious code, or harmful links

3.4 Conflicts of Interest

You must disclose any relationship that could create a conflict of interest:

  • Do not review your own business
  • Disclose if you are a competitor
  • Disclose if you have a personal relationship with the business owner
  • Disclose if you received compensation or incentives

3.5 Content Moderation

We reserve the right to:

  • Remove content that violates these Terms
  • Edit content to remove prohibited elements
  • Delay publication pending review
  • Preserve content for legal purposes

4. Reviews and Ratings

4.1 Review Guidelines

When writing reviews:

  • Only review businesses you have actually used
  • Be specific about your experience
  • Be fair and constructive
  • Include relevant details (date, product/service)
  • Update your review if circumstances change

4.2 Rating System

Our rating system:

  • 5 stars: Excellent experience
  • 4 stars: Good experience
  • 3 stars: Average experience
  • 2 stars: Poor experience
  • 1 star: Very poor experience

Rate based on your overall experience with the business.

4.3 Review Editing and Deletion

You may edit or delete your own reviews at any time. Edited reviews display an "Updated" indicator. Deleted reviews may be retained in anonymized form for platform integrity.

4.4 Business Responses

Businesses may respond to reviews. Responses must also comply with these Terms. Responses that are harassing, threatening, or violate guidelines may be removed.


5. Business Accounts

5.1 Claiming a Business

If you represent a business, you may claim and manage its profile. You must:

  • Be authorized to represent the business
  • Verify your association through our verification process
  • Provide accurate business information
  • Keep information up to date

5.2 Business Conduct

Businesses must not:

  • Create fake reviews or ratings
  • Offer incentives for positive reviews without disclosure
  • Threaten or intimidate reviewers
  • Create fake competitor reviews
  • Manipulate ratings or rankings
  • Report legitimate reviews as false

5.3 Review Solicitation

Businesses may invite customers to review, but:

  • Invitations must go to all customers, not just satisfied ones
  • You may not selectively invite customers likely to leave positive reviews
  • Any incentives must be disclosed and offered regardless of rating

5.4 Paid Services

Paid business services are subject to separate terms. Payment does not influence review moderation or ratings. All businesses, paid and free, are subject to the same review policies.


6. Prohibited Activities

6.1 General Prohibitions

You must not:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Impersonate others or misrepresent your identity
  • Interfere with platform operations
  • Circumvent security measures
  • Use automated tools without permission
  • Harvest or scrape data
  • Engage in spam or unauthorized advertising
  • Create multiple accounts
  • Buy or sell accounts, reviews, or ratings

6.2 Manipulation

Any attempt to manipulate reviews, ratings, or rankings is strictly prohibited, including:

  • Fake reviews (positive or negative)
  • Review trading or exchanges
  • Paid review services
  • Coordinated review campaigns
  • Bot-generated content

6.3 Consequences

Violations may result in:

  • Content removal
  • Account suspension or termination
  • Business profile removal
  • Legal action
  • Reporting to authorities

7. Intellectual Property

7.1 TrustEverest Property

The TrustEverest name, logo, website design, and all related intellectual property are owned by TrustEverest. You may not use our trademarks without permission.

7.2 User Content License

You retain ownership of content you create. By posting content, you grant TrustEverest a worldwide, non-exclusive, royalty-free license to use, modify, display, and distribute that content.

7.3 Copyright Claims

If you believe content infringes your copyright, contact us at TrustEverestReviews@gmail.com with:

  • Identification of the copyrighted work
  • Location of the infringing content
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your signature

8. Disclaimers

8.1 Service Provided "As Is"

TrustEverest is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • Accuracy or reliability of reviews
  • Quality or trustworthiness of businesses
  • Uninterrupted or error-free service
  • Security of data or communications

8.2 Third-Party Content

We do not endorse or guarantee the accuracy of user-generated content. Reviews represent individual opinions and experiences.

8.3 Business Relationships

TrustEverest is not a party to transactions between users and businesses. We are not responsible for business conduct, products, or services.


9. Limitation of Liability

9.1 Exclusion of Damages

To the maximum extent permitted by law, TrustEverest shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from user content
  • Damages from third-party actions

9.2 Liability Cap

Our total liability for any claims under these Terms shall not exceed the amount you have paid to TrustEverest in the past twelve months, or $100, whichever is greater.


10. Indemnification

You agree to indemnify and hold harmless TrustEverest, its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of our Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the issue informally.

11.2 Governing Law

These Terms are governed by applicable law. You agree to submit to the jurisdiction of the courts in our jurisdiction for any disputes.


12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

  • Updating the "Last Updated" date
  • Sending email notification for significant changes

Continued use of our Services after changes constitutes acceptance of the updated Terms.


13. General Provisions

These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and TrustEverest.

13.2 Severability

If any provision of these Terms is found invalid, the remaining provisions continue in effect.

13.3 No Waiver

You may not assign your rights under these Terms. We may assign our rights to any successor.
